The Most Common Types of Accident Claims

Thousands of accidents happen everyday and everywhere. On the road, in the backyard, at school, at work or play, and everywhere in between, the unexpected happens and can result in personal injury or property damage. When the accident that results in this injury or damage to property is caused by someone other than the injured party, it usually opens up the possibility or likelihood of an insurance or liability claim being filed.

road accident Some of the more common accident claims are road accident claims, work related accident claims, accidents in the home, falls, holiday mishaps, and accidents that are caused by defective products or equipment. All of these different types of accidents can lead to varying claims. Traffic accidents, for instance, can involve injury to drivers and passengers as well as pedestrians and cyclists who were in the wrong place at the wrong time. Damages resulting from being hit by the vehicles involved or by other objects propelled by the force of being hit can also be a source of accident claims. Personal injury claims are by no means the only ones that can come into play. Damages are often rewarded regarding expenses or financial loss that was due to the accident. These "special damages" might include loss of future earnings, medical costs, prescription costs, traveling expenses to and from hospitals, doctors' offices, and so forth that are a result of the accident. If the injured party has to hire someone to do jobs he or she can no longer perform, these costs might also be included in the claim as well as damage to or loss of property. Every case is different and will have different claims associated with its particular circumstances.

The success of a claim depends on being able to prove that the person against whom the claim is filed was negligent and caused the damages included in the claim as a result of that negligence. "Special damages" will only be granted when there is evidence presented that supports the amount of the claim. The court will set amounts to be awarded in the case of claims for pain and suffering or loss of future earnings.

In most cases, accident claims will have to be filed within a certain time frame, or the right to make the claim will be lost. Though situations vary, and different time limits might prevail in certain cases, the usual time limit is within three years of the accident. These types of claims are often quite complicated and the services of competent and qualified legal counsel may be necessary to insure their success.

If you have received injuries or damages as a result of an accident, think long and hard before you give up your right to seek financial compensation for them. Those injuries may affect the rest of your life even if it isn't obvious at the present time. Conditions may develop later that are a direct result of the accident, and they might severely limit your ability to continue your life as you have known it. The money you may be awarded could make a big difference in the quality of your life from that point on. If you are legally entitled to compensation through an accident claim, then be sure you take the necessary steps to receive it.
